Understanding the Eviction Process

To understand the eviction process you need to understand the role the “operative notice” plays in the lawsuit. 

The “operative notice” is the notice that is attached to the complaint.

Sometimes landlords send many notices before they decide to file an eviction lawsuit, also called an Unlawful Detainer or UD. 

The Notice that is attached to the complaint is the one that is the “basis” or reason for the eviction lawsuit.

We call it the “operative notice.” You should too.

The ”operative notice” is the first step the landlord takes to evict you.
